Nirbhaya case: SC to hear curative plea tomorrow

 

A five-judge bench of the Supreme Court, headed by Justice N V Ramana, will hear tomorrow, a curative petition filed by Nirbhaya case death row convict, Akshay Kumar Thakur.

The other four judges on the bench will be Justices Arun Mishra, Rohinton Fali Nariman, R Banumati and  Ashok Bhushan.

Thakur, a death row convict in the 16th December, 2012, gang rape and murder case, had filed a curative petition, seeking commutation of his capital punishment to life imprisonment.

The curative petition, filed by Akshay, submitted that the courts have not considered his family background, economic and financial condition and first time offender while awarding death sentence in the case.

“We want that the Supreme Court should hear our matter and commute the capital punishment to life imprisonment,” it stated.

Akshay’s review petition has been dismissed by Apex Court, forcing him to file the curative plea.

Earlier today, the Supreme Court dismissed a challenge by Mukesh Singh against the rejection of his mercy plea by the President.

A lower court had issued the death warrant against Akshay and three others — Mukesh Kumar Singh, Vinay Sharma and Pawan Gupta — for February 1 in the case related to the bestial gang rape and murder of 23-year old physio therapist in Delhi, which had shocked the conscience of the nation.
