Man sentenced to one year imprisonment in cheque bounce case

Jammu), March-19-2024:  Chief Judicial Magistrate, Samba reet Simran kour Grover delivered a verdict convicting one person in Cheque bounce dating back to year 2018 and sentenced him one year imprisonment.

The convicted accused identified as Balwan Singh S/o Mukhtiyar Singh R/o Chana Kana , Samba has been sentenced to one year of impresoment, in addition to a substantial fine and compensation payable to complainant.

 

As per details, the case revolves around 5 cheques each issued by accused Balwan Singh in favour of complainant namely Goutam Singh the cheques amounting to Rs 11,5000/- in total 5 draws from Jammu Cooperative Bank Ltd Branch Samba. However, when the cheques were presented for encashment encashment at the bank, it got dishonoured due to Account close” and accordingly, legal notice was issued to accused however despite notice was served to him, he failed to make the payment. Hence the present complainant before court under section 138 NiAct for judicial determination.

 

Accordingly, CJM Court sentenced him to one year of simple imprisonment to the said fire cheques. Further, Court also sentenced him by way to the the time of Rs 11,50000/- Eleven lac fifty thousand alongwith simple interest of 9 percent per annum for the date of cheque till the date of judgement of conviction court further order that whole amount of fine shall be paid as compensation to complainant. In case of default of fine the accused shall further undergo simple imprisonment of six months. JNF
