Court acquits husband facing trial in murder of wife

 Principal Sessions Judge Rajouri Jaffer Hussain Beigh acquitted Mohd Zulifkar S/O Mohd Latief R/O Saaj Tehsil Thannamandi, District Rajouri who was facing trial in murder of his wife.

          Principal Sessions Judge Rajouri Jaffer Hussain Beigh after hearing both the sides observed that There is no evidence of the prosecution on record with respect to the fact that the accused has committed the murder of the deceased even by the Dupatta which was seized by the investigating agency at the disclosure statement of the accused. There is even no confessional statement of the accused that he committed the murder of the deceased. In view of above discussion when there is no direct or indirect evidence of the prosecution on record to prove that the accused has committed the murder of the deceased, it is very difficult to agree with the prosecution case that the accused committed the murder of the deceased. The result is that the Challan is dismissed and the accused is acquitted.

          The prosecution case in brief is that on 14.04.2014 the Police Station Rajouri received information through a reliable source that the accused Zulifkar was residing in Ward No.1, Kheora along with his wife Tahira Parveen where the said Tahira Parveen was found to have been killed by someone. On this FIR No.180/2014 for offence u/s 302 RPC stood registered in Police Station Rajouri. JNF
