Court directs SSP Reasi to file status report on missing of a person for last 2 years

Chief Judicial Magistrate Reasi Amarjeet Singh Langeh directed SSP to file status report in a case of missing of a person for the last two years.

In the application filed by father that his son namely Ashok Singh was working at Baradari (name of place) in Reasi dealing with loading of sand, bajri and stones in vehicle from River Chenab; that on 12.06.2018, while his son had gone for work aforementioned to River Chenab, he was abducted by non-applicants from Zero Morh Talwara; that this was learnt by applicant from some persons during the process of tracing of his son; that applicant filed a missing report and an application for registration of FIR against non-applicants with police post Talwara on 14.06.2018; that the non-applicants had also severely beaten the son of applicant many times when he used to go on work; that SHO Police Station, Reasi and Incharge Police Post, Talwara have not taken any action on the application/ complaint of the applicant; that on 25.11.2018, applicant approached to SSP, Reasi requesting her to intervene into the matter and take appropriate action but no action was taken by SSP, Reasi; that on 23.09.2019, applicant also approached to IGP, Jammu but nothing was done by him also; that on 03.02.2020, applicant also approached Hon’ble Lieutenant Governor of U. T. Of J&K but nothing has been done yet etc. etc.

  The grievance of applicant is that no tangible action has been taken on his applications described above and he therefore has chosen to approach this court with prayer that SHO Police Station, Reasi be directed to register an FIR against accused for offences under sections 364, 365 & 368 of RPC and other relevant provisions of penal statute, trace his son and investigate the matter in accordance with law. An affidavit in support of this application, as aforesaid – has also been filed.

CJM after gone through the application observed that the contents of application and relevant material annexed therewith – would show that applicant has not only approached SSP, Reasi with aforesaid grievance but also represented before Inspector General of Police – Jammu as also his excellency Hon’ble Lt. Governor of U. T. Of J&K on 03.02.2020.  CJM Reasi further observed that 7 the application in hand would show that allegations here in pertain to missing of a human being on 12.06.2018. The allegations obviously are grave. Matter seems to have been brought to the notice of IGP, Jammu as also SSP, Reasi by applicant in writing. Not in murmurs but in a loud and clear manner, applicant has repeated the allegations before authorities aforementioned. Applicant is on affidavit that police has chosen not to show its indulgence in the matter. In light of allegations as grave as penpictured in the application, it needs to be ascertained as to what scale and extent an indulgence has been exhibited by police in the matter. Law does not permit matters like one at hand to be kept in dark tunnel in a way that grates against the mandate of penal law. At this stage, nothing more needs to be said and directed SSP to file status report. JNF
