Ban Terror Attack Court grants 10 days Police remand of three to NIA

In  a much publicized Ban Toll Plaza Terrorist Attack on 31st January, 2020 in which 3 Pak militants of JeM outfit gunned down, 3 Pulwama OGWs arrested, NIA after taking over the case from local police today produced uheel Javid @ Sohail Lone S/o Javid Maqbool Lone R/o Wager, PS-Khansaab, District Budgam, ii. Zahoor Ahmed Khan S/o Ghulam Hassan Khan R/o Banagund, District Pulwama & iii. Suhaib Manzoor S/o Manzor Ahmed Wani R/o Karimabad, District Pulwama seeking remand for the period of 10 days.

          Special Judge NIA Subash C Gupta after gone through the case dairy, granted 10 days police remand.

          Court after perusal of perusal of the  CD file , it  transpires that on 09.02.2020, the above named accused were arrested in Case FIR No;45/2020 of P/S Nogrota for the commission of offences under sections 307/120-B/121/122 & 123  IPC, 7/25 ,26,27  Arms Act ,16 & 18 UA(P) Act. It can further be gathered that on 10.02.2020, they were remanded to police custody for seven days. Tomorrow, on Sunday (holiday), it is being expired. Be it noted that  investigation of the case was handed over to  NIA by the  Ministry of Home  Affairs,Govt of India . It further becomes evident that consequent there upon, NIA, Jammu registered  the baove  titled Case FIR . Yesterday, this court ordered the transfer of the relevant record of  CD file, Case Property & custody of the accused to the CIO-NIA/Jammu  by the local police of P/S Nagrota.

          Keeping in view the nature of the case, the stage of investigation, gravity of offences involved in the present matter, Court is satisfied that it is impeerative to remand of the accused as prayed for in the instant application. Accordingly, they are remanded to police custody for a period of ten (10) days. The CIO is directed to arrange the medical examination of the accused, after every 48 hours during the remand period. The accused , who are remanded are apprised of their rights to  engage legal counsel/s and to have advice  from him/them, in the matter.
