Court framed corruption charges against then ADC and Ors in corruption case

JKUT (Jammu), December-13-2021-( JNF):-   Additional Sessions Judge Anticorruption Udhampur SC Katal framed corruption charges against Nasir Iqbal Parray, the then Collector Land Acquisition, Addl. Dy. Commissioner, Udhampur . Mohd Saleem Banday, the then Patwari Halqa Mand Udhampur and some beneficiaries whereas discharged Pritam Singh Singh, Shamsher Singh, Balvinder Singh, Subash Singh, Sansar Singh, Satpal Singh, Dharam Singh and Kuldeep Singh from the charges leveled against them.

          According the ACB case that The Case was registered on the basis of a verification conducted by ACB into the allegations of fabrication of revenue records and the release of compensation money disproportionately amongst the beneficiaries in village Mand, District Udhampur by Sh.Nasir Iqbal Parray, the then Addl. Deputy Commissioner, Udhampur & Mohd Saleem Banday, the then Patwari Halqa Mand, Udhampur, in league with the beneficiaries thereby wrongfully and dishonestly facilitating the release of compensation amount for acquisition of land for National Highway. During the investigation, it was found that a total amount of Rs.29,07,857/-was illegally and fraudulently disbursed by the accused revenue officers/ officials as compensation among the beneficiaries by depriving the genuine land holders thus causing a loss of Rs.29,07,857/- to the state exchequer.

          While framing charges, Additional Sessions Judge Anticorruption Udhampur after hearing Special PP Himanshu Parkash for the ACB, observed that keeping in view of the above discussion this court of considered view that the prima facie case is made out against accused No. 1 and 2 that they in pursuance of the criminal conspiracy hatched with the accused No. 3,5,9,10,11 and 12 by misusing their official position have disbursed the excess compensation thereby deprived the other shareholders whose names are reflected in the apportionment statement register. The liability of the govt. does not come to end in respect of genuine claimants reflected in the apportionment statement therefore, the accused no 1 & 2 being public servant have also caused huge loss to the Govt. Exchequer. Accused No. 3 Gopal Singh, Accused No. 5 Madan lal , Accused No. 9 Fateh Singh, Accused No.10 Tara Singh, Accused No. 11 Gandeep Singh and Accused No. 12 Jaktar Singh in pursuance of criminal conspiracy have received excess compensation at the costs of genuine claimants and therefore, accused Nasir Iqbal Parray the then Collector Land acquisition and accused Mohd Saleem Banday the then Patwari Halqa Mand are charge-sheeted for the commission of offences under sections 5 (1) (d) and Section 5 (2) J& K P.C.Act read with Sections 467/468/471 and 120-B RPC and Gopal Singh, Madan Lal, Fateh Singh, Tara Singh, Gandeep Singh and Jaktar Singh are charge-sheeted for the commission of offences under Section 120-B RPC and Pritam Singh Singh, Shamsher Singh, Balvinder Singh, Subash Singh , Sansar Singh, Satpal Singh, Dharam Singh   and Kuldeep Singh are discharged. JNF
