Court reject police cop& other  involved in selling of heroine

JKUT (Jammu), October-20-2021-( JNF):-   Additional Sessions Judge Kathua Kamlesh Pandit rejected the bail application of Manzoor Ahmed police cop working in District Court Kathua and Ram Saroop in NDPS Case.

          In this case as per the police report that on 09-09-2021, Police of P/S Hiranagar headed by PSI Vikram Singh Manhas were performing naka duty on the way back to Police Station at about 1450 hrs when reached at Bandhi Nala near Pulli, one person on seeing the police vehicle tried to hide himself in nearby bushes who was lateron caught. . During initial investigation, he(accused) disclosed his name as Ram Saroop S/o Late Faquir Chand R/o Kannah, Kootah. During course of search and personal checking police has recovered 40 grams of heroine from his possession. On this, case under FIR No.118/2021 came to be registered against the said accused person u/s 8/21/22 under NDPS Act and investigation was taken up by Inspector Anil Sharma, SHO Hiranager. On the course of questioning the arrested accused Ram Saroop disclosed that he has bought this 40 gms contraband heroin from Manzoor Ahmed who works at District Court Kathua.

          Additional Sessions Judge Kathua Kamlesh Pandit observed that One of the accused person bought the seized contraband from the other accused person who happens to be the employee of the disciplined belt force and incidentally posted in Malkhana where all the contraband is deposited for trial of the cases. Police report reveals that one of the accused person used to purchase the contraband from the other one namely Manzor Ahmed earlier also. It can not be ruled out that the seized contraband might have been drawn from the Court Malkhana. Moreso when police officials indulge in such illegal activities ,God will only save the society.

          Court further observed that The drug traffickers like accused person are spreading the addiction of Narcotics & Psychotropic substances among the youth section of society making them slaves of the same who when become addicts not only spoil their lives but also ruin the lives of their family members, therefore, the release of the accused persons/applicants herein at this stage will not meet the ends of justice. Consequently in the facts and circumstances of the instant case, the apprehension of the prosecution appears to be reasonable that once the accused persons are admitted to bail, they will not debar themselves from tampering with prosecution evidence or repeating the offence, moreover, it would have adverse affect on the society at large. Therefore, while considering all what has been discussed herein above and without going into the merits of the case, the accused persons/applicants herein have failed to convince this court for their admission on bail. Consequently bail plea of accused/applicants is out rightly rejected. JNF
