HC Directs AAG to File Latest Status Report Of Preliminary Inquiry
In a significant order, Justice Javed Iqbal Wani of J&K High Court (through video conferencing) has directed AAG Aseem Sawhney to file the latest status report in view of the furnishing of material by the petitioner in terms of Order dated August 19, 2019 in the shape of Newspaper clippings and the compact disc (CD) highlighting Pro-Azadi speeches made by Dr. Farooq Abdullah Ex-CM, Patron NC and presently Member of Parliament.
When this much publicized writ petition filed by Social Activist Sukesh C. Khajuria seeking finalization of the preliminary inquiry initiated on his complaint into Pro-Azadi speeches of Dr. Farooq Abdullah came up for hearing, Advocate Sheikh Shakeel Ahmed with Advocates Supriya Chouhan, Mohammad Zulkarnain Chowdhary and Irtiza Mushtaq Salaria appearing for the petitioner submitted that despite passage of almost one year, the SSP Srinagar and SHO Police Station Nageen (Srinagar) has not furnished the latest status of the ongoing inquiry against Dr. Farooq Abdullah for his Pro-Freedom speeches made on December 5, 2016 at Naseem Bagh (Hazratbal) Srinagar and further on February 2, 2017 at Nawa-e-Subh, headquarters of NC at Srinagar.
Advocate S.S Ahmed further submitted that on August 19, 2019 the Court had directed the petitioner Sukesh C. Khajuria to handover the material viz. Newspaper clippings and a compact disc (CD) to AAG Aseem Sawhney for taking the inquiry to its logical conclusion.
Advocate S.S. Ahmed further submitted that it was on August 30, 2019 the entire material was provided to AAG Aseem Sawhney for its onward delivery to SSP Srinagar and SHO P/S Nageen in order to facilitate the completion of ongoing inquiry against Dr. Farooq Abdullah. He further submitted that on September 27, 2019 this Court had directed SSP Srinagar and SHO P/S Nageen to file latest status report of the inquiry but till date the needful has not been done.
After hearing both the sides, Justice Javed Iqbal Wani directed AAG Aseem Sawhney to file latest status report of the ongoing inquiry within a period of two weeks and further directed the registry to list this petition on 9th September 2020.JNF
