Court framed charges against two Ex-DCs & ors in Fake gun License scam

Jammu: December-20-2023-( JNF):- Special Judge CBI Jammu Bala Joyti today framed charges against Faqir chand Bhagat then DC Rajouri, Javed Ahmed Khan then DC Shopian and Parmod Kumar in fake gun license scam.

 

prosecution case is that on the basis of complaint filed by Sh. K.KSharma the then Addl. DG, BSF and on the basis of result of enquiry an FIR came to be registered by CBI.ACB Jammu bearing No. RC 0042017A0004 dated 28.09.2017 and wherein FIR, it is alleged that Pramod Kumar Sharma ‘M/S Nav Durga Gun House’, Manhas Market Ploura Jammu (J&K) private person, Sukhwinder Singh, Commandant, Faquir Chand, the then District Magistrate Rajouri and unknown persons were part of criminal conspiracy during the year 2013 and in pursuance to said criminal conspiracy Sh. Sukhwinder Singh commandant by abusing his official position arranged the meeting of Parmod Kumar Sharma an ex-constable of BSF who is owner of MIS Nav Durga Gun House1 Jammu persuaded them to get private arms licence in lieu of Rs. 12,000/-each, the amount being higher than the requisite fee on the basis of false and forged documents knowingly using these documents as genuine. It is the case of prosecution that the then District Magistrate Rajouri (Now retired) by misusing his official position, issued all the questioned arms licence in violation of existing rules and procedures and without due verification prior to issuance of arms licence on the basis of false and forged documents. It is also the case of prosecution that constable Parmod Kumar Sharma earlier served in BSF before coming into business of preparation of fake gun licence whereas accused No.2 Faquir Chand Bhagat remained posted as District Magistrate (Deputy Commissioner) Rajouri from April 2013-Nov. 2013 Sh. Mohd. Aslam Bhatti was performing the duty of Judicial Clerk during his tenure at Rajouri whereas accused Mohd Javed Khan remained posted as District Magistrate ( Deputy Commissioner) ‘Shopian’ and during this period all these accused persons namely Parmod Kumar Sharma constable. Faquir Chand Bhagat former District Magistrate Rajouri along with Sh Mohd, Javed Khan former DM Shopian connived with each other and issued 12 gun licences against payment of Rs, 12,000/- each and thereby has abused their official positions to procure pecuniary advantage amounting Rs 1.44,000/-, Prima facie, it is found that accused Faquir Chand Bhagat issued 10 gun licences and accused Mohd. Javed Khan issued 02 gun licences with connivance of accused No.1 Parmod Kumar Sharma, It is found prima facie that accused Parmod Kumar in furtherance of criminal conspiracy managed his entry in BSF campus Gandhi Nagart Gujarat and cheated gullible BSF personnel by inducing them to pay Rs. 12,000/- against the requisite licence fee of Rs. 60/- and submitted forged documents to his co-accused Faquir Chand Bhagat the then DM Rajouri and Mohd. Javed Khan the then DM Shopian those have issued total 12 arms licences in question to BSF personnel without adhering to the due procedure and guidelines issued and in gross violation of rules and regulations and mandatory norms.

 

Special Judge CBI Bala Joyti after hearing Public Prosecutor VK Dogra for the CBI, observed that entire material on record, it appears that prima facie offences U/S 120-B r/w 420, 467,468 and 471RPC 5(1) (d) r/w 5(2) of J&K P.C.Act Samvat 2006 and section 30 Arms Act 1959 are made out against afl accused persons and further certainly there are grounds for proceeding against each of them as such charges are framed against all the accused persons separately under sections 120-B r/w 420, 467,468 and 471RPC 5(1) (d) r/w 5(2) of J&K PC. Act Samvat 2006 and section 30 Arms Act 1959 for the commission of aforesaid offences. JNF
