Jammu May-31-2023:- 2nd Additional Sessions Judge Srinagar Renu Dogra today awarded 10 years rigorous imprisonment and fine Rs 25000 to Irshad Ahmad Malik S/O Habib-ullah Malik R/o Ahlan Gadwak Kokernag Anantnag at present Anchar Soura for rape with minor.
The prosecution case as culminated in the form of present charge-sheet is that on 18thof May 2012 complainant lodged a written report with the police of Police Station Soura to the effect that he is a labour by profession and used to go out of his house daily in the early morning for work and return back in the evening. At his home there lives his daughter (name with held)and his wife. In his neighbourhood one person namely Irshad Ahmad Malik S/o Habibi-ul!ah Malik lives in the house of one Ghulam QadirWani S/o Sh Mohammed Wani R/o Sheiklh Mohallah Soura as a tenant. His minor daughter used to go to his residence(Dara).Some days before, his daughter rcomplained of pain in abdomen as such he took his daughter(Victim) to doctor for treatment where the doctor conducted some important tests of the girl and doctors certified that victim girl was having a child in her womb. He and his wife enquired from their daughter who disclosed that the person who resides in their neighbour-hood resident of Rajouri namely Irshad Ahmad has several times raped her .
After receiving the report, police registered the case under FIR No 33/2012 for the commission of offence punishable under Section 376 RPC in police Station Soura.
2nd Additional Sessions Judge Srinagar Renu Dogra after hearing both the sides observed that Having regard to the totality of the circumstances including the fact that the offence has been committed with the minor girl, I am of the considered opinion that 10 years of imprisonment with fine is an adequate punishment for accused in the instant case. Accordingly, this Court sentence 10 (Ten) years of rigorous imprisonment and fine of Rs 25,000/- to the Convict Irshad Ahmad Malik S/O Habib-ullah Malik R/o Ahlan Gadwak Kokernag Anantnag at present Anchar Soura for the commission of the offence under section 376 RPC. In case of default in payment of fine, the accused shall further undergo simple imprisonment for a period of 6 months. Convict who is present in the court shall be taken forth with and be lodged in Central Jail Srinagar to serve the sentence so imposed. JNF
