Court issues notice to I/C SIT, SHO Bagh E Bahu in bail Application of JKP SI, another directs to file status report of case
Jammu May-22-2023:- The Special Judge POCSO cases Jammu Sudhir Khajuria issued notice to Incharge of SIT, SHO Bagh E Bahu and minor in a bail plea of J&K Police Sub Inspector Sardar Ali and Muzaffar property dealer in a case of alleged abduction and recovery of minor girl Ramada a five star hotel of Jammu.
The Bail plea was filed by accused through Advocates A K Sawhney and Aseem Kumar Sawhney with Tahseena Bukhari and Sarafaz Ahmed Advocates. It was submitted before the Court that the accused are totally innocent and have been framed up as the accused Sardar Ali is a Police SI and husband of a DDC Member and his father is a BDC Chairperson and belongs to a respectable family. Other accused is a young boy of 27 years and have been framed in a false and fabricated case.
It was submitted by Adv Aseem Sawhney in the petition that there is no question of abducted of the girl as she had herself come to the hotel to meet Muzaffar her friend and the SI also reached there being a close friend to counsel and reason them and desist from any life decision and thus was present there to advise and counsel the young friends and infact had told the girl to take her family into confidence in case both the boy and girl had any intention of marrying. However, it was submitted that neither there was any abducted or any other crime related to POCSO or anything, but due to smear campaign has been maligned and booked in this fabricated case.
Adv. Sawhney said that evidence on the file and CCTV footage will reveal that the minor reached there on her own without any coercion, pressure or duress. It would also reveal that there was no force on the girl and she had reached on her own and only some talks took place and petitioner Sub Inspector tried to counsel and advised the due not to play with their lives as she is still minor by a few months.
The entire story being projected in the media is wrong and factually incorrect only the malign the young men.JN
