Court acquits Inspector CB in corruption case

JKUT (Jammu), November-01-2021-( JNF):-   Special Judge Anticorruption Srinagar acquitted Police Inspector Ghulam Hassan Kamal in corruption case.

          According to the Vigilance case is that , the facts of the case are that a written complaint was lodged on 15.10.2010 at P/S VOK by the complainant namely Khurshid Ahmad Sanai alleging therein the complaint that Crime Branch, Jammu had registered a case FIR No. 19/2009 against CA&PD department regarding embezzlement of huge stocks of food grains meant for Marwah/Wadwan and he was arrested during investigation and later on released on bail by the competent court. The IO of the said case is demanding Rs. 4.00 lacs for exonerating him from the case and has directed him to pay Rs. 50,000/-as first installment on 15.10.2020 in the evening at Hotel Bishember Nagar, Srinagar, where he is putting up. The complainant under compelling circumstances approached VOK along with bribe amount of Rs. 50,000/- which he was going to pay to the accused Ghulam Hassan Kamal, the then Inspector Crime Branch Jammu for taking action against the accused. On receipt of this complaint, a case FIR No. 33/2010 was registered in P/S VOK U/S 5(2) P. C. Act. Svt. 2006 r/w Section 161 RPC and investigation was set into motion. A team of officers/officials of VOK was constituted to lay a trap, besides the services of a Magistrate was also sought from Dy. Commissioner, Srinagar who deputed Shahbaz Ahmad Bhoda, Tehsildar, who was associated with the proceedings as independent witness. In the course of investigation the complainant produced Rs. 50,000/-consisting of forty-nine Indian currency notes of one thousand rupee denomination and two Indian currency notes of five hundred rupees denomination, which he intended to pay as illegal gratification to the accused on demand.

          Court after hearing both the sides observed that prosecution has failed to prove the charge leveled against the accused beyond all reasonable doubt. The charge against the accused therefore fails and the accused deserve his acquittal. The accused is accordingly acquitted. JNF
