Different Yardstick to deal while giving employment to the candidates from Kashmir Division & Jammu Division

CAT directs respondents to consider the applicants for selection of MVI

 JKUT (Jammu), July-23-2021-( JNF):-  In a petition filed by         Mahmood Ahmed and Monty Kangotra of Jammu Division aggrieved of discrimination of Transport Department for selection of Motor Vehicle Inspectors.

         A Bench of Central Adminstrative Tribunal Comprising Rakesh Sagar Jain and Anand Mathur after hearing Sr. Adv Rahul Pant with Adv Nishant Shukla for the petitioners observed that this Tribunal found that undoubtedly the prescribed qualification for candidates from Jammu and Kashmir Division is same, however in the matter of selection, the respondents have taken different yardstick to deal with their cases and while giving employment to the candidates from Kashmir Division, the respondents rejected the case of the applicants with similar qualifications, as such the applicants have been discriminated against.

         CAT held that the qualification possessed by the applicants is similar to the qualification prescribed for Kashmir Division and directed the respodents to declare the result of the applicants and based on their result, consider the applicants for selection to the post of Motor Vehicle Inspector, Jammu Division.

         The case of applicants Mahmood Ahmed and Monty Kangotra, who belong to Jammu Division, is that they applied for the post of Motor Vehicle candidature/selection has been rejected solely on the ground that the work experience from a reputed automobile workshop was undertaken by them before they were awarded their educational degree/diploma. It is the further case of the applicants that prescribed qualification for candidates from Jammu and Kashmir region were similar, however, in contradiction to the rejection of the case of the applicants, respondents have selected the candidates from Kashmir Division, despite the fact that those candidates from Srinagar had also got their experience before they received their qualification degree/diploma. JNF
