Principal Sessions Judge Samba Mohd Akran Chowdhary rejected the bail application of one Vinod Dubey S/O Ram Krishan R/O Jakh Tehsil Vijaypur District Samba against whom P/S Bari Barahamana register FIR in NDPS Act.
As per police report that on 06.11.2019, the police of police station Bari Brahmana was on patrolling duty and when reached near railway bridge, flyover, Bari Brahmana, noticed a person coming towards Teli Basti, Bari Brahmana. On seeing the police party, the person tried to run away, but he was apprehended by the police. On personal search of the applicant/accused, one polythene bag was recovered from his backside which was hidden between the pent and shirt and on opening the bag, 08 challis of charas was found. On receipt of docket, a case was registered at Police Station Bari Brahmana vide FIR No. 196/2019 U/Ss 8/20 NDPS Act and the investigation was initiated. During investigation, the recovered charas, on being weighed was found 150 gms and the applicant was arrested.
Principal Sessions Judge Samba Mohd Akran Chowdhary after hearing Public Prosecutor Javed Khawaja for the State whereas Adv Ganesh Sharma for the applicant observed that offence of which the applicant has been accused carries punishment of 10 years imprisonment and fine of Rs. 1 lakh. Given to the severity of punishment, the offence is serious in nature. Otherwise also the menace of trade and use of narcotic drugs and psychotropic substance has become alarming to society in general and young generation in particular. This menace requires to be curbed with a heavy hand as it is eating into vitals of the polity. The case of applicant is at initial stage of investigation and in my considered opinion, having regards to the facts and circumstances of the case, particularly the serious nature of offence, the applicant is not entitled to grant of bail at this stage. With these observations court rejected the bail application.
