Court rejects bail of frduaster
JKUT (Jammu), August-03-2021-( JNF):- A Local Court in Jammu District rejected the bail application of Gafoor Ahmed who got selected as constable in police on fake matriculation certificate.
Accoridng to the police case that 2. P/P Parade in its report submitted that the applicant/accused has been arrested in case FIR No. 109/2018 u/ss. 420/467/468/471 IPC. It is submitted in the report that a written letter has been received from SSP office vide letter no. OSI/Apptt./2018/36706-15/DPOJ dated 11-07-2018 for lodging FIR with contents that in pursuance of PHQ advertisement issued under no. Pers-A-21/2010/14804-903 dated 07-04-2010 for the recruitment of post of constables in Jammu and Kashmir Police, District Jammu was conducted by the Board constituted vide PHQ OB. No. 1632 of 2010 dated 29-04-2010 . during the recruitment process, the Board after taking physical measurement/test, checked the educational certificates, other records and recommended a list of 650 candidates to PHQ/ADGP Armed for approval, which was approved by the PHQ vide OB. No. 513 of 2011 dated 14-02-2011 and ADGP Armed vide OB. No. 57 of 2011. the approved list was received the office of SSP Jammu from ZPHQ Jammu zone, Jammu vide Letter No. Pers/Apptt/2011/4230-32 dated 19-02-2011 with direction to issue the formal appointment order after completing required formalities which includes checking of original educational certificates, Professional certificates, PRCs and Category certificates etc. accordingly selected candidates were called to DPO Jammu and their original documents were collected for verification. During the course of issuance of appointment Order an anonymous complaint has been received against one selected candidate namely Gafoor Ahmed S/o Doud R/o Sagoon, Jammu regarding production of fake matriculation certificate. The said candidate was not appointed due to pending verification of educational qualification certificates and the complaint was forwarded to SDPO Nagrota along with xerox copy of the matriculation certificate of the accused. 3. Now the SDPO Nagrota vide his letter dated 13-06-2018 has communicated that a detailed verification report has been received fron J&K BOSE vide Letter No. F(Veri-B) JD/2018/2525 dated 31-03-2021 conveys that the said certificate is clear cut fake. The accused was also called by SDPO Nagrota who has deposed in the enquiry that he obtained 10th calss certificate from one Zaffar R/o Poonch A/P Sani Colony, Jammu on payment of Rs. 10,000/- and used the said certificate for his selection J&K Police. The act on the part of the accused prima facie proves commission of offence of cheating by making forged document and using the same as genuine before competent authorityfor obtaining job in Police department which warrants legal action under law. On receipt of this letter a case FIR No. 109/2011 u/ss. 420, 467, 478, 471 RPC has been registered.
Spl. Mobile Magistrate Passenger Tax Khem Raj Sharma after hearing APP Manmohit Sharma for the prosecution observed that governing principles, the peculiar facts and circumstances of the case, considering the societal interest and the State, the bail is rejected. JNF
