DB adjourn Roshni Review petitions for December 22, 2020
JKUT (Jammu), August-02-2021-( JNF):- The High Court of Jammu and Kashmir and Ladakh Bench comprising of Chief Justice Panakj Mithal and Justice Puneet Gupta today heard the review petitions in the much famous Roshni land case and posted these cases for 6th of September, 2021.
When the matter was taken-up for hearing, the Division Bench took on record the Action Taken Report filed by Adv Monika Kohli, on behalf of CBI.
DB observed that on one of the previous occasions, the Court has noted that there are as many as 43 review applications filed for review of the judgment dated 09.10.2020. The delay in filing those review applications, if any, was condoned.
Today, it has been informed that some more review applications have come to be filed and to be precise the number is 62.
DB observed that in all those review applications which have been filed after the previous order dated 28.01.2021 and those which are likely to be filed henceforth, the review petitioners have to explain the delay on merits.
DB asked Advocate General to prepare a synopsis in a tabulated form concerning each of the review petitions in two sets, those filed up to 28.01.2021 and those filed thereafter. In addition to the review applications, there are several applications seeking clarification of the aforesaid judgment and order.
Those applications would also be considered along with the review petitions and the review application No. 37 of 2020 filed by the State would be considered as the leading review petition.
This apart there are some writ petitions in relation to the Roshni Act which would also be shown separately along with review applications.
DB further directed Registry to to indicate the review applications separately and the other miscellaneous applications, such as, those seeking clarification and the writ petitions separately in sequence after the leading review application. JNF
