Court reject bail of Drug Dealer
JKUT (Jammu), May-29-2021-( JNF):- Additional Sessions Judge Kathua Kamlesh Pandit rejected the bail application of one Mohd Ashraf Sheikh who is one of the Drug Dealer.
Court observed that 3. In this case, challan has been presented before this court by way of transfer on 12-05-2021 against the two accused persons(including 143/Bail the applicant herein) and other co accused person namely Wazir Chand has since absconded. The allegations against the accused persons are that on 17-11-2020 police party of Police Station Hiranagar headed by SI Arun Slathia were on patrol duty at Dayalachak near Railway bridge. During patrolling about 18:15hrs one person was noticed going towards Dinga Amb from Dayala chack with a bag on his shoulder, who on seeing police party , tried to give slip to the police but was caught hold. The said person disclosed his name as Dilbagh Singh S/o Baldev Singh R/o Katli and during search 500 grams of heroin was recovered. On this, case under FIR No.114/2021 came to be registered against the accused person u/s 8/21/22 NDPS Act and was detained. The investigation was set into motion. During investigation it came to surface that the said Dilbagh was hand in glove with the other co-accused including the applicant herein who by way of abetment and in furtherance of criminal conspiracy , were neck deep in, drug trafficking. Consequently offence u/s 29 NDPS Act also came to be slapped on the accused persons.
Additional Sessions Judge Kathua Kamlesh Pandit while rejecting the bail application observed that The drug traffickers like accused person are spreading the addiction of Narcotics & Psychotrpic substances among the human race especially youth section of society making them slaves of the same, who when become addicts not only spoil their lives but also ruin the lives of their family members. Therefore, the release of such accused person at this stage will not meet the ends of justice. Consequently in the facts and circumstances of the instant case, the apprehension of the prosecution appears to be reasonable that once the accused person is admitted to bail, he will not debar himself from tampering with evidence, repeating the offence and hindering the further trial in the case also.
