Two heroin smugglers get 10 years RI

Jammu June-02-2023- Additional Sessions Judge Kupwara Khem Raj Sharma today awarded 10 years rigorous imprisonment and fine Rs 1 lacs each to two heroin smugglers namely Mohammad Shafi Lone and Bilal Ahmad Dar.

 

Prosecution story in brief is that a Case FIR No. 45/2020 under sections 8/21 NDPS Act was registered by Police Station Crime Branch Kashmir (Srinagar) on receipt of an information through reliable sources that two persons namely Mohammad Shafi Lone S/o Mohammad Ramzan Lone R/o Bomia, Edipora, Sopore and Bilal Ahmad Dar S/O Ghulam Qadir Dar R/o Sadiq Colony, Bye Pass, Sopore were carrying Narcotic drugs (HEROIN like substances) in Chevrolet vehicle bearing Regd. No. HP22E-5622 and are going to sell the same to the youth of Drugmulla and Kupwara areas. After registration of FIR investigation was set into motion through Inspector Nisar Ahmad of ANTF Kashmir. During the personal search of the individuals afore said, i.e., driver of the vehicle namely Bilal Ahmad Dar along with another person namely Mohd Shafi Lone two polythene bags containing contraband Narcotic drugs apparently “Heroin” like substance was recovered from their possession and accordingly personal search memo was drafted on the spot in presence of the Magistrate aforesaid. The recovered substance got weighed by the Legal Metrology Officer in presence of the Executive Magistrate and weight of the contraband recovered from the possession of Mohd Shafi Lone was found to be 435gms and weight of the contraband recovered from the possession of Bilal Ah Dar was found to be 372gms. After completion of investigation challan was presented.

 

Additional Sessions Judge Kupwara Khem Raj Sharma after hearing both the sides observed that the menace of drugs is on increase in these days and main sufferer of this menace is younger generation of society and due to this menace, the life of younger generation is being put on the peril of destruction thereby affecting not only the individual families but the society in large also and in order to save the youth, who are future of the society, from destruction the easy availability of drugs including supply thereof at doorsteps is to be curbed with an iron hand. But considering the mitigating circumstances which overweigh the aggravating circumstances, Court awarded a sentence of rigorous imprisonment of 10 years and fine of Rs. 1 Lakh to both the convicts/accused persons. In default of payment of fine aforesaid the convicts/accused persons shall undergo further sentence of rigorous imprisonment of 2½ years. JNF
