The case set up by the Prosecution is that Accused nos. 1, 2, 3, 4 & 5, the then officials of the Food Corporation of India, FCI for short hereafter posted in District Kupwara, entered into a criminal conspiracy with private-persons, including the Road Transport Contractors; Commission-agents and others, and in pursuance thereof they cheated the FCI by misappropriating the stocks of food grains at Food Storage Depot (FSD)-FCI, Kupwara by abusing and misusing their official position/s in league with one another and defrauded the FCI of a huge amount, approximately in the sum of Rs.11,05,70,817/- only, and accordingly the Accused nos.1 to 18 committed the offences made punishable under Sections 201 & 201 of RPC read with Section 120-B of the code (supra) and Section 4(H) & Section 5(2) of the J&K Prevention of Corruption Act, Svt. 2006 read with Section 5(1)(d) of the Act (supra) 2006.
