Court reject bail in fake appointment scam

JKUT (Jammu), December-24-2021-( JNF):-   CJM Jammu Amarjeet Singh Langeh rejected the bail application of one Harmeet Singh of Pulwama who was arrested by the Nowabad police station in fake appointment scam.

          According to the police case that an FIR no. 190/2021 for offence under section 420 of IPC came to be registered against peiioner in the backdrop of allegaions that he received an amount of Rs. 4 Lakhs from complainant and his friend against assurance that he would provide them job of driver in NHPC office at Jammu; that an amount of Rs. 3,90,000/- was allegedly paid to petitioner on 2nd of June, 2021 in cash at Jewel, Jammu while as another amount of Rs. 10,000/- was transferred to his account maintained in J&K Bank; that petitioner assured them the provision of job in the month of Aug. 2021 but he failed. Further, allegations as outlined in the applicaion are that when complainant and his friend demanded refund of amount so paid to him, peiioner allegedly refused. Complainant accordingly alleged that he and his friend have been cheated and defrauded hence prayed for registration of FIR which was registered as aforementioned. During investigation, petitioner came to be arrested on 14.12.2021 and during his personal search a fake Aadhar Card, fake PDD I-Card carrying his photograph with fake name and address, some cheques, 03 ATM Cards and a mobile phone have been recovered from him. Besides, a copy of document – (fake appointment letter) was also allegedly recovered from petitioner purported to have been issued from office of Chief Engineer NHPC, Regional office, Jammu wherein sanction for appointment of fourteen individuals including complainant seems to have been granted/approved for Class-IVth/driver post. 5. The evidence collected during investigation as on date would explicitly show that petitioner made fraudulent job offer and collected money not only from complainant and another and thus duped them of their money amouning to Rs. 4 lac but, as evidence would show – he (peiioner) also indulged in luring un-suspecing and gullible people to exploit their desperaion for job by making false promises of providing them various jobs against money and he thus seems to have flourished a huge racket of providing fake jobs in NHPC. Invesigaion would also reveal that PDD Identity Card allegedly recovered from petitioner though contained his photograph but the name refected therein is “Mandeep Singh”, a fake name. Further, six cheques stated to have been recovered from petitioner amounting to Rs. 25.5 lakhs which petitioner allegedly used to openly display so as to persuade different gullible sections of job seekers that many other persons have already approached him for job and have also deposited cheques with him for said purpose. Again, the appointment letter by virtue of which complainant was allegedly appointed as driver with NHPC has also been found to be fake on verification during investigation. For all these reasons, offences under sections 467 & 468 of IPC have also been added in the case.

          CJM Jammu Amarjeet Singh Langeh after hearing APP Kuldeep Kumar Bhat for the UT whereas Adv Rafiq Mir observed that what is un-settling is that despite having collected vital evidence like forged appointment order, fake Identity Card etc- Investigating agency does not seem to have shown keenness to further dig out wider manifestations of case in hand including antecedents of petitioner and patronage that he may have in perpetuaion of alleged racket of providing fake appointment orders as alleged in the case. Let copy of this order shall go to SSP Jammu for information and necessary action in this regard.          Thus having regard to the nature of accusation, evidence in support thereof, influence of accused, quantum of punishment that offences in quesion do carry, fear of tampering with prosecuion evidence and witnesses and larger interest of Public or State, I am of the considered opinion that no case is made out by petitioner for grant of bail at this stage. This application therefore has no merit and is dismissed as such. JNF
