PIL regarding improvement of medical facilities and the infrastructure in JK

DB directs AAG to ensure that the reports of the Committees be placed before the court

JKUT (Jammu), December-23-2021-( JNF):-   In two different Public Interest Litigation regarding improvement of medical facilities and the infrastructure in the then State of Jammu and Kashmir  now Union Territory, A Division Bench comprising Chief Justice Pankaj Mithal and Justice Puneet Gupta, directed AAG appearing for the Health & Medical Education Department, UT of J&K to submits that he will ensure that the reports of the Committees are placed before the court at the earliest.           DB further directed AAG to place the record within one month.

          When the PIL came-up for hearing, Division Bench observed that two public interest litigations are regarding the inadequate medical facilities in the Government Medical College at Jammu and for the establishment of Organ Transplant Center in J&K.

          DB observed that the court vide common order dated 28.02.2020 passed in both the petitions, appointed a Committee of Experts for the Jammu Division as well as Kashmir Division and both the Committees were directed to be headed by Dr. Yogesh Chawla, retired Director, PGIMER, Chandigarh and the Directors Health Services Jammu and Kashmir were directed to coordinate and work as the Member Secretaries of the Committees and the members of the Committees were requested to visit the government hospitals in J&K to examine the current facilities available with regard to infrastructure, human resources and equipments in various departments, and to suggest the development to be undertaken in the phased manner with the estimated cost.

          DB further observed that in pursuance to above direction of the court, we are told that the Committees have started functioning but initially they could not visit the hospitals on account of COVID-19 pandemic but this Court do not find that the Committees have furnished any report so far and directed  AAG to submits that he will ensure that the reports of the Committees are placed before the court at the earliest. JNF
