Court reject bail in Hit & Run case
JKUT (Jammu), December-13-2021-( JNF):- CJM Jammu Amarjeet Singh Langeh rejected the bail application of Shah Mohd who killed one SPO on duty at Naka at Manda by hitting.
While rejecting bail application, CJM Jammu Amarjeet Singh Langeh while rejecting the bail application, after hearing Adv Sandeep Singh for the applicant whereas APP Kuldeep Bhat for the police observed that It needs no brainer to underscore that profound, massive and an in-depth response to a horrific crime perse serves as a potential deterrence for those having criminal proclivity and antecedents. It also needs to be underlined that in the case in hand life of police man on duty has not only been imperilled but also done away with. Investigation reveals that Petitioner was doing reconnaissance alongwith PW Ali Mohd and ensured that a Tipper driven by Farooq Ahmed thrice fetched Sand/Bajri from Majalta and un-load it somewhere in Jammu. Occurrence is alleged to have taken place when after third delivery of Sand by Tipper in question, trio aforesaid was on its way back to Majalta. What is expected from investigating agency in as heinous a crime as one in hand is to collect entire contextual evidence during investigation instead of digressing itself to sort of an expectation of mediation about compensation between an accused and victim family. Such an approach flies in face of basic tenets of criminal jurisprudence and it un-wittingly provides latitude to an accused, in not a trivial, but grave and heinous crime. It is here the role of Supervisory Officer atleast at the level of Deputy Superintendent of Police in the hierarchy of investigating agency – assumes significance.
According to the police case is that police station received a telephonic information from a police official deputed at Manda Nakka for night checking duty on 24.11.2021 that while police officials were performing their Nakka duty at aforesaid place, one Alto car – white in colour bearing registration no. 5789 being driven by an unknown person from Jammu city towards Nagrota in a rash and negligent manner when reached at aforesaid barrier, the driver concerned lost control over the same, broke the barrier at Nakka point and hit constable on duty namely Qayoom Ali as a consequence of which said constable was critically injured and shifted to Govt. Medical College – Jammu for treatment etc. etc. Based on this information FIR no. 196/2021 for offences under sections 279/337 of IPC was initially registered. Subsequently, however injured allegedly succumbed to injuries in hospital. JNF
