Court grants interim bail to JE caught by CBI

JKUT (Jammu), December-06-2021-( JNF):-   Special Judge Anticorruption (CBI Cases) Sanjeev Gupta granted interim bail to Junior Engineer Sanjay Koul whio was caught red-handed by the CBI while accepting bribe Rs 3 lacs.

          As per report filed by PP, allegedly the case was registered on the basis of a complaint made on 29.11.2021 by one Mohd. Adiem Parihar alleging demand of bribe of Rs. 03 lacs at the hands of accused Hilal Ahmad Sheikh, serving as Superintendent Engineer, PWD (R&B), Circle Udhampur-Reasi for processing the file related to technical sanction of the project awarded to the complainant through tender for construction of Medical Sub-Centre in District Reasi in 2017-2018, of which complainant had executed some part of project. However, during negotiation, accused Hilal Ahmad Sheikh agreed to accept Rs. 1.5 lacs as bribe to be paid to his technical officer and the remaining amount be paid later on after receipt of bill amount. The complainant told accused Hilal Ahmad Sheikh that he cannot arrange Rs. 1.5 lacs in cash and stated that some cash and remaining amount by cheque will be arranged. Reportedly CBI laid trap at PWD Guest House at Udhampur on 02.12.2021 and graft amount of Rs. 40,000/- in cash and a cheque of Rs. 1,10,000/- total Rs. 1.5 lacs, lying in an envelope which was kept in a bag by the petitioner was recovered which was accepted by him from the complainant on behalf of accused Hilal Ahmad Sheikh on the instructions of accused Predhimen Krishan Koul. Petitioner having been arrested on spot on 02.12.2021 was remanded to custody by CBI for custodial interrogation. Presently, petitioner is on judicial remand.

          Special Judge Anticorruption (CBI Cases) Sanjeev Gupta after hearing both the sides observed that keeping in view the medical issues related to the petitioner pointed above, but without commenting on merit of the matter of the matter, I am of the considered opinion that petitioner has made out a case at this stage for grant of interim bail in his favour. The petition is accordingly allowed and the petitioner is admitted to interim bail who shall be released from custody on furnishing surety and personal bonds in an amount of Rs. 50,000/- each, subject to conditions that  the petitioner shall report to investigating officer for being further associated with investigation as and when required, the petitioner shall not try to influence the prosecution witnesses and the petitioner shall not leave the jurisdiction of this

court without prior permission from IO.

          Court further ordered that any breach   of   either   of   these   conditions   shall   warrant cancellation of bail.  And fixed the application on 10.12.2021 for consideration and on said date petitioner shall appear in the court. JNF
