Court reject bail of snatchers
JKUT (Jammu), November-29-2021-( JNF):- CJM Jammu Amarjeet Singh Langeh rejected the bail applications of snatchers Balwinder Kour W/O Kulwant Singh and Pavaneet Singh S/O Narinder Singh.
According to the police case that a written report with police post Gadigarh alleging therein that while she was coming home after attending function at Jammu in vehicle bearing registration no. JK02CQ-7859 on 14.11.2021 and when she reached Gadigarh for purchasing bakery from Jagdev Bakery Shop Gadigarh, one Scooty without registration number driven by unknown Sikh boy and one lady pillion rider reached from opposite side and stopped the said Scooty near her. Complainant further alleged that pillion rider lady snatched her purse containing one Mangalsutra, 02 golden Lady rings and cash amounting to Rs. 20,000/-, ATM cards and some other documents. Based on this complaint, FIR no. 263/2021 for offence under section 382 of IPC was registered with police station concerned and investigation started.
CJM Jammu Amarjeet Singh Langeh after hearing APP Kuldeep Bhat for the UT observed that while considering bail application of persons who seem to be prima facie habitual offenders, discretion to grant bail cannot be exercised in a whimsical manner and interest of society at large in such cases has also to be duly considered and taken note of ( Vide (2007) 1 SCC 70). In the case in hand, all factors viz nature and gravity of offence involved, character of evidence in support of allegations, punishment that the offence involved carries – which is upto ten years of imprisonment and general impact on public at large of the offence involved in the case – go poignantly against petitioners more particularly when investigation is at initial stage and subject matter of theft has not been wholly recovered. With these observations Court rejected bail application. JNF
