Court reject bail of Rohingyas in theft case
JKUT (Jammu), November-24-2021-( JNF):- Municipal Magistrate Jammu Parvin Pandoh rejected the bail application of Rohingyas namely Mansur Kamal and Mohd Yaseen who was arrested by the police for theft in Grid Station Sidhra.
According to the police case that an application was received from Assistant Executive Engineer TLMSD that during the intervening night of 10th and 11th of November 2021 an attempt of theft was made at Grid Station Sidhra and it was observed that 8 to 10 persons entered in the Grid Station with the intention of theft and all of them managed to escape from the site alongwith stolen goods including cooper coil of damaged transformer lying at Grid Station. Earlier on 19th of February, 2021 one of their contractor M/s Power Tech Engineers had also lodged a complaint regarding theft of their material from the Grid Station Sidhra. FIR No. 426/2021 u/s 379 IPC was registered. During investigation, it was found that the accused persons alongwith other persons stole the copper coil after cutting the transformer. Some of the employees woke up and the accused persons left the spot alongwith stolen material leaving behind their motorcycle bearing registration no. JK02CN-2589. Later, the applicants herein came back to out their motorcycle out. The moment they started the motorcycle, the employees of all the Grid Station caught hold of accused and handed over them to police. Certain recoveries were made on the basis of the disclousre statement of the accused persons. Copper wires measurings about 30/40 kilos were recovered from the accused persons.
Municipal Magistrate Jammu Parvin Pandoh after hearing APP Vikram Parihar for the UT observed that the accused are Myanmar nationals so if the accused are granted bail at this stage, there is every possibility of the accused absconding and thereby evading the due course of justice. The criminal law set in motion vide FIR in the instant case. may never end in the culmination of trial thereby affecting the criminal justice system. The applicants are not entitled to concession of bail at this stage. With these observations Court rejected the bail application. JNF
