HC grants last opportunity to SSP Sgr & SHO Nageen to file latest status report
JKUT (Jammu), November-16-2021-( JNF):- In a significant order Justice Mohd. Akram Chowdhary of High Court of Jammu and Kashmir and Ladakh (Jammu Wing) granted last and final opportunity to Senior Suprintendent of Police, Srinagar and Station House Officer, Police Station, Nageen (Srinagar) to file the latest status report positively within a period of 4 weeks with regard to the Preliminary Inquiry initiated against Dr. Farooq Abdullah former Chief Minister J&K and Patron National Conference on the complaint of Social Activist Sukesh C. Khajuria for his seditious /Pro-Azadi speeches made on the occasion of 111th birth anniversary of Late Sheikh Mohammad Abdullah at Naseem Bagh (Hazratbal) Srinagar and another speech on February 24th 2017 at Nawa-e-Subh Headquarters of National Conference at Srinagar during the 2nd Death Anniversary of Former General Secretary of National Conference Sheikh Nazir Ahmed.
After hearing Advocate Sheikh Shakeel Ahmed with Advocates Supriya Chouhan and Mohd. Zulkarnain Chowdhary appearing for the petitioner Sukesh C. Khajuria, who has been seeking registration of FIR against Dr. Farooq Abdullah for his Pro-Azadi/Seditious Speeches, whereas AAG F.A. Natnoo appearing vice AAG Aseem Sawhney appearing for Home Department of J&K Government, Justice Mohd. Akram Chowdhary while expressing displeasure over the dilatory tactics adopted by the SSP, Srinagar and SHO, P/S Nageen reluctantly allowed one last and final opportunity while observing that further adjournment is sought by the AAG F.A. Natnoo for filing the latest status report on behalf of the SSP, Srinagar and SHO, Police Station, Nageen.
Advocate S.S. Ahmed appearing for the petitioner Sukesh C. Khajuria invited the attention of the court towards order dated September 27, 2019 when on the directions of the court a compact disc (CD) and newspaper clippings were supplied by the petitioner Sukesh C. Khajuria to AAG Aseem Sawhney containing the material regarding Pro-Azadi Speeches of Ex-Chief Minister Dr. Farooq Abdullah for further transmission to SSP, Srinagar and SHO, P/S Nageen for completion of preliminary inquiry.
Advocate S.S. Ahmed vehemently argued that since September 27, 2019 the SSP, Srinagar and SHO, Nageen have not filed the latest status of the preliminary inquiry and Advocate Ahmed sought their personal appearance in view of inordinate delay in the filing of the status report. On the other hand, AAG F.A. Natnoo appearing vice AAG Aseem Sawhney sought yet another opportunity to comply the orders of the court.
After considering the submissions of both the sides, Justice Mohd. Akram Chowdhary reluctantly granted last and final opportunity of four weeks to AAG F.A. Natnoo to file the latest status report regarding the Preliminary Inquiry initiated against Dr. Farooq Abdullah former Chief Minister J&K and patron National Conference for his Seditious /Pro-Azadi speeches and looking into the importance of the matter the court directed the Registry to list this matter on December 20, 2021.
