CAT refuse to stay the order of deputation to Ladakah of Joint Director

JKUT (Jammu), November-16-2021-( JNF):-   Central Administartive Tribunal refused to stay the deputation of Dr. Tara Chand Joint Director Sheep Husbandry who sent on deputation to Ladakh.

          The applicant Dr. Tara Chand filed the present O.A. seeking quashment of order dated 01.11.2021 whereby he has been sent on deputation to Union Territory of Ladakh. He has challenged the impugned order on a number of grounds. He also seeks interim relief for staying of the operation of the impugned dated 01.11.2021 and also order dated 03.11.2021 whereby he has been relieved from his present place of posting as Incharge Joint Director by Respondent No. 2 without deciding his representation.

          The Bench Central Administrative Tribunal Comprising Rakesh Sagar Jain and Anand Mathur after hearing both the sides observed that The applicant stands relieved from the post of Incharge Joint Director and it is also a matter of record that he has filed a representation against the impugned order. Looking to the fact that the applicant stands relieved we are of the opinion that no prima facie case is made out by the applicant for staying the operation of the impugned order dated 01.11.2021 and 03.11.2021. Accordingly, the prayer for interim relief is rejected.
