One year imprisonment in accident death case
JKUT (Jammu), October-30-2021-( JNF):- Observing that “a deterrent punishment is required in road accident cases”, a Special Mobile Magistrate Electricity Aarti Mohan has awarded one-year imprisonment to a car driver for killing pedestrians in 2009.
Accoridng to the prosecution case that on 20-06-2009 for disposal under law. Briefly slated the case of the prosecution is that on 17-04-2009 at about 5:50 am information was received in police station Peer Mitha that one Maruti car bearing No. JK02F-1414 which was being driven by accused Nissar Ahmed in rash manner and in high speed was going from DC office crossing towards Shaheedi Chowk at about 5:45 am when the vehicle Maruti car reached near Bhilwi Showroom Wazarat road, Jammu, the driver lost control over the car and went on the wrong side of road where it hit two pedestrians namely Sansar Chand and Krishna Rani critically injuring them. Both the injured fell down. The vehicle which causedthe accident was also standing on the spot. On the basis of this information FIR No. 22/2009, u/s 279/337 RPC was registered. The injured did not survive and 304-A RPC was added.
Court after hearing APP Anil Saini for the Police observed that the challan in hand is pending for the considerable long period of time and accused is facing trial since the year 2009, the accused is sentenced to simple imprisonment of one year u/s 304-A RPC and a fine of Rs. 10,000/-. The accused is also sentenced to simple imprisonment of one month u/s 279 RPC as also a fine of Rs. 1000/- both the sentences shall run concurrently. On default of payment of fine he shall undergo further imprisonment for 15 days u/s 304-A RPC and five days u/s 279 RPC. Accused has also failed to produce the mechanic certificate and on that court also a fine of Rs 1000/- is imposed upon him. JNF
