Court reject bail of two thieves
JKUT (Jammu), August-25-2021-( JNF):- CJM Jammu Amarjeet Singh Langeh rejected the bail applications of Ravi Kumar and Sourav Kumar who were arrested by the police in theft case.
CJM Jammu Amarjeet Singh Langeh after hearing APP Kuldeep Bhat for the Police observed that The investigation brings to sight that only few of the stolen items have been recovered till date. That apart, investigation has also cast spotlight on the fact that petitioners are facing trial in as many as – five cases and ironically, all these cases pertain to theft and house breaking. Despite having been booked to face trial in aforesaid number of theft cases, still petitioners, instead of dumping their instinct to repeat the offences, indeed, chose to re-indulge as professionals by resorting to theft involved in FIR in question. All this indicates that petitioners are chronic and repeat offenders and therefore are not soft stuff to be granted concession of bail on facts at this stage. The fact that they were rounded up from Patankote ipsofacto speaks volumes about their inter-state connections as alleged by prosecution. It is trite and perhaps needs no re-iteration that character of evidence gathered during investigation, gravity of the offences involved, the character and antecedents of accused and larger interest of public in the event of grant of bail are the fewest of the circumstances that need to be considered. In the instant case, all these circumstances are poignantly poised against petitioners, more particularly when some vital aspects of the matter are still under investigation. With these observations Court rejected the bail application. JNF
