Court reject bail in murder case
JKUT (Samba), August-10-2021-( JNF):- Principal Sessions Judge Samba Sonia Gupta rejected the bail application of one Raman Kumar who was facing trial in murder case.
According to the police case that on 18.02.2011 at about 4:00 PM at Tapyal Nallah, Tehsil Samba, he alongwith accused Neelam Rani, having common intention to commit murder of Nagar Singh on exhortation of accused Neelam Rani, attacked Nagar Singh with a dah and accused Neelam Rani hit the deceased with a stone on his head, who fell down and then accused Neelam Rani attacked Nagar Singh with a darat and caught hold of his hands, whereupon the applicant/accused cut the throat of Nagar Singh with the dah and thereafter destroyed the SIM card of his mobile phone.
Principal Sessions Judge Samba Sonia Gupta after hearing both the sides observed that it is revealed that after conclusion of evidence, the file is posted for final arguments. The applicant/accused and co-accused Neelam Rani have committed murder of Nagar Singh, which is a serious offence and the same is punishable with capital or life imprisonment. In view of the heinousness of the offence, in my opinion, the applicant/accused is not entitled to concession of bail for the period, as prayed. The case is at the final stage and there are chances of his absconding from the course of justice. So far as the ground of parity is concerned, accused Neelam Rani was admitted to bail on different footing being a woman and applicant/accused Raman Kumar does not fall in the said category. With these observations, the Court rejected the bail application. JNF
